Different reasons for ending employment have different consequences.

What to keep in mind
- Final settlement and compensation are not the same.
- Voluntary resignation has different consequences.
- Act promptly after dismissal: the general deadline is short.
General guidance for employees in Spain. The collective agreement, employment relationship and circumstances can change the answer. Seek employment advice for a specific dispute or deadline.
Separate the reason, money and deadlines
A document called a final settlement does not explain why employment ends. Start with who made the decision and its effective date. Settlement, possible compensation and unemployment protection are separate checks.
Temporary contract ends
Check the actual reason and duration. Notice and compensation depend on the type and case; they are not identical for every contract.
Dismissal
An employer decision assessed by reason, procedure and date. The general challenge period is 20 working days; get help calculating it.
Resignation
The worker decides to leave. Check the applicable notice. This alone does not create legal unemployment status or compensation entitlement.
Identify the notice
A temporary contract ending, dismissal and resignation are different. Ask for the document, reason and effective date and keep the notice. Do not sign a resignation you have not chosen or a blank document.
Settlement and compensation
Final settlement covers outstanding amounts such as pay, extra payments or holiday where applicable. Compensation is separate and differs by case. Request a breakdown and check amounts and payments before agreeing. You may request a staff representative’s presence when signing the settlement receipt.
Act before deadlines expire
Dismissal challenges generally have a 20-working-day deadline. Its calculation and suspension must be checked for your circumstances. Contact a union or employment professional promptly; an Inspectorate complaint does not replace a court claim.
Explore a worked example
The employer gives a €900 settlement. The worker assumes that it already includes any compensation.
How to interpret it
You cannot know without an itemised breakdown. Outstanding pay, extra payments, holidays and compensation are separate items; the example amount is fictional.
A useful next step
Request a breakdown and notice; check payment and deadlines without waiting for the transfer. Signing “not agreed” does not file a claim.
