What to keep in mind
- Protection and training are not at your expense.
- Protective equipment does not replace all prevention measures.
- For serious imminent danger, put safety first.
General guidance for employees in Spain. The collective agreement, employment relationship and circumstances can change the answer. Seek employment advice for a specific dispute or deadline.
Before, during and after an incident
In farming, warehousing, hospitality or care, prevention must fit real tasks. Heat, loads, chemicals or machinery require specific measures. A signed receipt does not replace the training needed to work safely.
Prepare
Ask about risks, understandable instructions, practical training and suitable protection. Safety training must be sufficient and job-specific.
Report
Report defects, unexplained tasks or symptoms. Do not bypass guards or improvise operations to keep up with a work rate.
Protect and document
If injured, seek care and explain that it happened at work. Record task, date and reports without risking yourself to collect evidence.
What the employer must organise
Prevention includes assessing risks, informing and training staff and providing appropriate protection. Safety measures must not be charged to workers. Personal equipment does not replace all collective and organisational measures.
Serious and imminent danger
Article 21 recognises the right to stop work and, where necessary, leave the workplace when serious and imminent danger threatens life or health. Inform the employer and safety representatives. Protection against adverse consequences has a legal exception for bad faith or gross negligence.
Evidence and help
Record facts, dates, tasks and reports without putting yourself at risk to obtain evidence. Consult safety representatives, the prevention service or Labour Inspectorate. If injured, seek medical care and explain that it happened at work.
Explore a worked example
A warehouse worker is asked to use a machine they have never operated. They are only told to copy a colleague.
How to interpret it
Watching someone else does not guarantee sufficient training. Appropriate competence, instructions and authorisations must be checked.
A useful next step
Request instructions and training before taking on the task, and report the risk through the safety channel.
